1. Our Customers

We proudly serve gardening enthusiasts across the globe who share our passion for vibrant annual plants, from Abutilon to Cleome. Our services are tailored for those who appreciate quality plants delivered directly to their doorstep. Please note that we currently cannot deliver to parts of Asia and some remote regions due to agricultural restrictions.

2. Website Use and Intellectual Property

All content on this website, including text, images, logos, and product descriptions, is the property of Annual Plants Popular Shop and protected by intellectual property laws. You may not reproduce, distribute, or use any content without our express written permission.

3. Product Information

We specialize in providing healthy, vibrant annual plants including but not limited to:

• Seasonal flowers like Angelonia and Celosia
• Foliage plants like Alocasia and Asparagus Fern
• Colorful varieties like Bougainvillea and Cajun Hibiscus

We make every effort to display our products accurately, but natural variations in color and appearance may occur. Plant sizes are approximate and may vary slightly from images.

4. Ordering and Payment

When you place an order, you are offering to purchase products under these terms. We accept the following payment methods:

• PayPal

All prices are in US dollars. Your order will be processed within 1-2 business days after payment confirmation.

5. Shipping Policy

We carefully hand-select and package each plant with specialized materials to ensure safe transit. We offer two shipping options:

• Standard Shipping ($12.95): Shipped via DHL or FedEx. Delivery within 10-15 business days after shipment.
• Free Shipping: Available on orders over $50, shipped via EMS. Delivery within 15-25 business days after shipment.

Shipping times may vary during peak seasons or due to unforeseen circumstances like weather events. We cannot guarantee exact delivery dates.

6. User Responsibilities

As a customer, you agree to:

• Provide accurate and complete information when placing orders
• Inspect plants upon delivery and notify us of any issues within 15 days
• Provide proper care for plants after delivery, including appropriate watering and light conditions
• Bring outdoor plants indoors during unsuitable weather conditions
• Comply with any agricultural regulations in your region

7. Returns and Exchanges

We accept returns and exchanges within 15 days of receipt. To be eligible:

• The plant must be in its original container with original soil
• It should not show signs of neglect, mishandling, or damage caused after delivery
• You must include your original order number and explanation of the issue

Non-returnable items include Cassia Plants, Asparagus Plants (edible varieties), plants that have been planted or repotted, and plants from seasonal promotions.

Refunds will be issued to the original payment method within 5-10 business days for credit/debit cards and 3-5 days for PayPal. Shipping costs are non-refundable.

8. Limitations of Liability

While we take extreme care in packaging our plants, we cannot be responsible for:

• Plants that perish due to improper care after delivery
• Damage caused by extreme weather conditions after delivery
• Plants that are not brought indoors during unsuitable weather (for outdoor plants)
• Delivery delays caused by carriers or unforeseen circumstances

Our total liability for any claim related to your order shall not exceed the purchase price of the plants in question.

9. Privacy and Communication

By placing an order, you agree to receive communications related to your purchase. We respect your privacy and will not share your information with third parties without your consent, except as required to process your order.

10. Governing Law

These terms are governed by the laws of the United States and the state of Alabama. Any disputes shall be resolved in the courts of Montgomery County, Alabama.
